Marriage registration in China is administered by local Civil Affairs Bureaus.

Specifically, following major regulatory reforms effective May 10, 2025, the process has been significantly streamlined.

Consequently, couples now benefit from nationwide access and reduced documentation requirements.

ELIGIBILITY REQUIREMENTS

     Both parties must:  

  • Be of legal age: Men ≥22 years, Women ≥20 years
  • Be unmarried: Single, divorced (with proof), or widowed (with death certificate)
  • Have no prohibited blood relationship: Not direct relatives or collateral relatives within three generations
  • Appear in person: Both parties must physically attend the registration office together
  • Have legal status in China: At least one party must reside/work in China; tourists generally cannot register.

      Who cannot marry a Foreigner in China?

           Chinese citizens who are:

  • Active military personnel, diplomats, or public security staff
  • Personnel handling state secrets
  • Currently serving criminal sentences or undergoing re-education.

REQUIREMENTS BY
PARTY TYPE

     A.)For the Chinese Citizen Partner

  • Valid Chinese ID card – Primary identification
  • Hukou booklet (optional)- No longer mandatory after 2025 reforms
  • Divorce decree/death certificate -If previously married.
  • Three joint photos, 2-inch, half-body, bareheaded, identical copies.

      B.)For the Foreign National Partner

  • Valid passport or international travel document -Must match name on all other documents.
  • Single Status Certificate (Legal Capacity to Contract Marriage).
      •  Issued by the home country authority or the embassy/consulate in China
      • Authenticated via Apostille (if Hague Convention country) OR consular legalization chain
      • Valid within 6 months of registration date
  • Certified Chinese translation of entire document -Must include: notary instructions, foreign ministry certifications, signatures, seals. The translation agency must affix the official seal
  • Proof of residence/work in China -Residence permit, work permit, student ID, or employment certificate
  • Three joint photos -Same specifications as the Chinese partner. 

       C.) For Hong Kong/Macao/Taiwan Residents

  • Mainland Travel Permit or Residence Permit-Plus HK/Macao ID card or Taiwan ID.
  • Notarized statement of no spouse & no prohibited blood relation-Issued by local notary; valid within 6 months.
  • Proof of residence/work in mainland China-Residence permit, work permit, etc.
  • Three joint photos-Standard specifications.

STEP-BY-STEP
REGISTRATION PROCESS

      Step 1: Prepare Documents (Start 2-3 Months Ahead)

  • Obtain and authenticate the Single Status Certificate or Legal Capacity To Contract Marriage (for a foreigner)
  • Arrange a certified Chinese translation
  • Prepare joint photos and supporting documents

      Step 2: Choose Registration Location

  • If one party is Chinese: Register at ANY marriage office nationwide
  • If both parties are non-mainland (e.g., foreigner + HK resident): Register where you work/reside.

      Step 3: Visit the Civil Affairs Bureau Together

  • Both parties must appear in person with original documents + copies
  • Complete marriage declaration forms (provided onsite)
  • Submit all required materials for verification.

      Step 4: Review & Registration

  • Staff verify documents, age, marital status, and relationship eligibility
  • If approved: Marriage certificate issued immediately (no waiting period)
  • Fee: Free of charge for registration.

      Step 5: Post-Registration (Optional but Recommended)

  • Register your marriage with your home country’s embassy in China
  • Keep authenticated copies of all documents for future immigration/legal needs.

After Marriage: Important Next Steps

  • Register with your embassy: Many countries (US, UK, Australia) recommend recording your Chinese marriage for consular services.
  • Apply for a family visa (Q1/Q2): Your Chinese spouse can sponsor your long-term residence.
  • Keep authenticated copies: Store digital + physical copies of your marriage certificate and all supporting documents
  • Consider prenuptial agreements: If significant assets are involved, consult a lawyer familiar with cross-border family law.

        The Bottom Line is that while China’s 2025 reforms have simplified marriage registration for Chinese citizens, foreign nationals must still carefully prepare authenticated documents. Ultimately, when done correctly, registration is typically completed in a single visit.
